Please read these Terms and Conditions carefully before using the Patriot Payments payment processing services, By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

  1. ABOUT PATRIOT PAYMENTS

Patriot Payments is an independent payment processing company that provides merchant services to small businesses across the United States. Patriot Payments operates as an independent sales organization (ISO) and reseller of payment gateway services powered by Accept Blue, a PCI Level 1 compliant payment gateway. Patriot Payments facilitates the relationship between merchants and payment processing partners but is not itself a bank, card network, or payment card issuer.

  1. SERVICES PROVIDED

Patriot Payments provides the following services:

  • Credit and debit card payment processing (online and in-person)
  • ACH and eCheck payment processing
  • Recurring billing and subscription payment management
  • Cash discount and surcharge program administration
  • Point of Sale (POS) terminal solutions
  • Payment gateway access powered by Accept Blue
  • Customer vault and tokenized payment storage
  • Invoice and payment link generation
  • Integration with GoHighLevel CRM platform
  1. ACCEPT BLUE GATEWAY SERVICES

Payment processing services are facilitated through Accept Blue, a third-party payment gateway provider. By using Patriot Payments services, you acknowledge and agree that:

  • Transaction processing is subject to Accept Blue’s platform terms, policies, and technical infrastructure
  • Accept Blue is a PCI DSS Level 1 compliant payment gateway. All cardholder data is processed, stored, and transmitted in accordance with PCI DSS standards
  • Patriot Payments does not store raw cardholder data. All sensitive payment information is tokenized through Accept Blue’s secure vault system
  • Accept Blue supports major credit cards, signature debit cards, ACH/eCheck transactions, and 3D Secure fraud protection
  • Transaction approvals, declines, and processing outcomes are determined by card networks, issuing banks, and Accept Blue’s processing systems — not solely by Patriot Payments
  1. MERCHANT OBLIGATIONS

As a merchant using Patriot Payments services, you agree to:

  • Provide accurate and complete business information during onboarding and maintain updated records
  • Comply with all applicable card network rules including Visa, Mastercard, Discover, and American Express operating regulations
  • Comply with all applicable federal, state, and local laws governing your business and payment processing activities
  • Maintain PCI DSS compliance for your business systems that interact with cardholder data
  • Not use the services for illegal, fraudulent, or prohibited transaction types
  • Promptly notify Patriot Payments of any suspected fraud, data breach, or unauthorized transaction activity
  • Honor all chargebacks and disputes in accordance with card network rules
  1. FEES AND BILLING

Patriot Payments operates on a transparent, no-contract fee structure. Specific fee schedules are disclosed in your merchant agreement. General terms include:

  • Processing rates and fees are disclosed upfront in your merchant services agreement — no hidden fees
  • Cash discount and surcharge programs, where applicable, must comply with all state and federal regulations governing surcharging
  • Patriot Payments reserves the right to adjust fees with advance written notice to merchants
  • Chargebacks may result in fees as outlined in your merchant agreement
  • No long-term contracts are required — merchants may cancel services in accordance with their individual merchant agreement terms
  1. GOHIGHLEVEL INTEGRATION

When using the Patriot Payments through the GoHighLevel platform:

  • The integration is subject to both these Terms and GoHighLevel’s platform terms of service
  • Patriot Payments is responsible for the payment processing functionality of the integration; GoHighLevel is responsible for its CRM platform
  • Merchant credentials and API keys are stored securely and never exposed client-side
  • Install and uninstall of the Patriot Payments app within GoHighLevel will create or remove your merchant association accordingly
  • Patriot Payments is not responsible for GoHighLevel platform outages or changes to the GoHighLevel platform that affect integration functionality
  1. PROHIBITED USE

You may not use Patriot Payments services for the following:

  • Illegal goods or services of any kind
  • Fraudulent transactions or misrepresentation of goods and services
  • Money laundering or financial crimes
  • High-risk business categories not approved in your merchant agreement
  • Processing transactions on behalf of a third party not covered under your merchant agreement
  1. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Patriot Payments shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to lost profits, data loss, or business interruption. Patriot Payments’ total liability in connection with any claim shall not exceed the total fees paid by you to Patriot Payments in the three months preceding the claim.

  1. INDEMNIFICATION

You agree to indemnify and hold harmless Patriot Payments, its officers, directors, employees, and partners from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising out of your use of the services, your violation of these Terms, or your violation of any third-party rights.

  1. TERMINATION

Patriot Payments reserves the right to suspend or terminate your access to services at any time for violation of these Terms, suspected fraud, excessive chargebacks, or any activity that poses a risk to Patriot Payments, Accept Blue, or card network partners. You may terminate services in accordance with your individual merchant agreement.

  1. CHANGES TO TERMS

Patriot Payments reserves the right to modify these Terms at any time. Updated Terms will be posted at patriotspayments.com and within the GoHighLevel Marketplace app listing. Continued use of services after changes are posted constitutes acceptance of the updated Terms.

  1. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
